An Act to amend the Indian Act.

 

[Assented to 9th March, 1961.]

 

 

HER Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

 

1. Section 112 of the Indian Act is repealed and the following substituted therefor:

“112. (1) Where a band has applied for enfranchisement within the meaning of this

Act and has submitted a plan for the disposal or division of the funds of the band and the lands in the reserve, the Minister may appoint a committee to inquire into and report upon any or all of the following matters, namely:

1. the desirability of enfranchising the band;
2. the adequacy of the plan submitted by it; and
3. any other matter relating to the application for enfranchisement or to the disposition thereof.
1. A committee appointed under subsection (1) shall consist of
1. a judge or retired judge of a superior, surrogate, district or county court,
2. an officer of the Department, and
3. a member of the band to be designated by the council of the band.
